Agency representation models vary substantially across state jurisdictions, and the 2024 NAR settlement did not alter state statutory agency laws. In states that permit dual agency (such as California under Civil Code § 2079.17), a single broker or licensee may represent both the seller and the buyer in the same transaction, provided both parties execute informed, written consent prior to or concurrently with signing the purchase agreement.

Conversely, several states strictly outlaw dual agency. In Florida (Fla. Stat. § 475.278), licensees cannot represent both sides as fiduciaries and operate under statutory Transaction Brokerage.
