Florida does not mandate state residency or U.S. citizenship. Non-residents who are actively licensed in states with which Florida maintains mutual recognition agreements (such as Georgia, Alabama, and Kentucky) can obtain a Florida license by passing a 40-question examination on Florida real estate law with a score of 30 or higher (75%), bypassing the 63-hour pre-licensing course. However, once an individual resides in Florida for four continuous calendar months, they are legally deemed a Florida resident and become ineligible for mutual recognition.

The initial license is issued with an expiration date of either March 31 or September 30, providing a validity period between 18 and 24 months. Prior to this first expiration deadline, sales associates must complete 45 hours of post-licensing education. There is NO grace period. If the associate fails to complete this course before midnight on the expiration date, the license becomes null and void automatically by operation of law. To re-enter the profession, the individual must re-enroll in the 63-hour pre-licensing course, retake the state exam, and reapply as a brand-new applicant.

To upgrade to a broker license, an applicant must have held an active sales associate license for at least 24 months during the 5 years immediately preceding application, complete the 72-hour Course II broker pre-licensing course, and pass the state broker examination.
