What is the primary difference between an Acknowledgment and a Jurat?
An Acknowledgment verifies that the signer appeared before the notary, was properly identified, and declared that they willingly signed the document (the document may be signed beforehand). A Jurat requires that the signer appear, be identified, sign the document IN THE PRESENCE OF the notary, and take a verbal oath or affirmation confirming truthfulness under penalty of perjury.
What constitutes 'Satisfactory Evidence' of identity for a notarial act?
Satisfactory evidence consists of an unexpired government-issued photo ID (driver's license, passport, military ID) with photo, physical description, and signature, OR the sworn oath of one credible witness personally known to the notary and signer, or two credible witnesses personally known to the signer.
Can a Notary Public give legal advice or prepare legal documents?
No. Unless licensed as an attorney, a notary is strictly prohibited from engaging in the unauthorized practice of law (UPL). This includes advising which notarial act to use, drafting legal instruments, or explaining legal ramifications.
What are the rules regarding notarial journal custody?
A notary's official journal is their exclusive personal property and must be kept in a secure, locked location under their direct control at all times. It may never be surrendered to an employer upon termination of employment.
