Immediately upon seating at your Prometric testing terminal and beginning the tutorial period, write down these critical legal distinctions on your scratch paper:

1. Civ Pro & Con Law Thresholds:
  • Diversity: Complete diversity + >$75,000 (single P aggregates all claims vs single D).
  • Supplemental: 28 U.S.C. § 1367(b) bars P claims vs Rule 14 third parties in diversity.
  • General PJ: Corporation 'at home' only in state of incorporation & HQ nerve center.
  • Equal Protection: Race/Religion = Strict; Sex/Illegitimacy = Intermediate; Age = Rational.
2. Contracts, Torts & Evidence:
  • UCC § 2-205 Firm Offer: Merchant signed writing, maximum 3 months irrevocability.
  • UCC § 2-207: Additional terms between merchants part of deal unless material alteration (arbitration!).

Master 28 U.S.C. § 1332 diversity, claim aggregation, § 1331 well-pleaded complaint rule, § 1367(b) diversity restrictions, specific personal jurisdiction under Ford Motor Co., and Twombly/Iqbal plausibility.

Week 220–25 HoursComplete 15 Con Law questions; review scrutiny tiers comparison table.

Constitutional Law & Justiciability

Article III standing (injury-in-fact, causation, redressability), Dormant Commerce Clause (Dean Milk vs. Pike), Equal Protection scrutiny tiers (strict, intermediate, rational basis), and First Amendment public forum doctrine.

Week 320–25 HoursComplete 20 Contracts questions; master UCC 2-207 material alteration rules.

Contracts & UCC Article 2

Predominant purpose test for hybrid goods/services transactions, UCC § 2-205 merchant firm offers, Restatement § 90 promissory estoppel, UCC § 2-207 battle of the forms, express conditions vs. substantial performance, and Hadley v. Baxendale consequential damages.

Week 420–25 HoursComplete 20 Torts questions; take first 30Q diagnostic practice test.

Torts & Strict Products Liability

Palsgraf Cardozo zone of danger, statutory negligence per se (Restatement § 14), res ipsa loquitur, proximate causation (intervening medical negligence), design defect risk-utility and reasonable alternative design (RAD), battery, transferred intent, and public figure actual malice.

Week 522–26 HoursComplete 25 Crim/Evidence questions; master FRE 609 crimen falsi vs. felony balancing.

Criminal Law, Criminal Procedure & Evidence

Model Penal Code mens rea, mistake of fact (honest mistake for specific intent), Pinkerton conspiracy, felony murder agency theory, Fourth Amendment automobile exception vs. Gant, Fifth Amendment Edwards unambiguous counsel invocation, FRE 403 balancing, and FRE 801/803 hearsay exceptions.

Week 624–28 HoursTake full 60-Question 180-Minute NextGen Mock Exam; review all distractor autopsies.

Real Property, Business Associations & Full Simulation

Fee simple determinable vs. condition subsequent, joint tenancy severance, implied warranty of habitability, easements by necessity, Notice vs. Race-Notice recording acts, RUPA partnership profit sharing, Delaware duty of care gross negligence, and corporate veil piercing.
